The following sets forth the Privacy Policy for the website (“Site”) operated by Cornucopia Living, LLC, a New Jersey limited liability company  (the “Company”).  Throughout the Site, the terms “we”, “us” and “our” also refer to the Company. By visiting the Site and/or purchasing something from us, you agree to be bound by the terms of this Privacy Policy. This Privacy Policy applies to all users of the Site, including, without limitation, users who are browsers, vendors, customers, merchants, and/or contributors of content.

Please read this Privacy Policy carefully before accessing or using our Site.  By accessing or using any part of the Site or purchasing any of our products, you agree to be bound by this Privacy Policy. If you do not agree to all the terms of this Privacy Policy then you should not access or use the Site, purchase any or our products or use any of Site services.  You can review the most current version of our Privacy Policy at any time on this page.  We reserve the right to update, change, or replace any part of this Privacy Policy posting updates and/or changes to this page. It is your responsibility to check this page periodically for changes. Personal Information We Collect

When you visit the Site we may collect certain information about you or your computer or other electronic device, including information about your web browser, IP address, and some of the cookies that are installed on those devices.  Additionally, as you browse the Site we may collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Personal Information.”   We may collect Personal Information using the following technologies:

“Cookies”, which are data files that are placed on your computer or other device and can include an anonymous unique identifier;

We use the Personal Information that we collect to fulfill orders for our Products placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations).  Additionally, we can use the Personal Information to communicate with you, screen orders for potential risk or fraud, and when consistent with the preferences you have shared with us, provide you with information or advertising relating to our products or services, or with targeted advertising or marketing information we believe may be of interest to you.  In addition, we may use Personal Information to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our advertising).  Further, we may use and transfer your Personnel Information as described below under “California Privacy Rights”.

Consent

When you provide us with Personal Information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase,  you are consenting to our collecting it and using it for the reasons described herein.   After you give us consent to use your Personal Information  you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your Personal information, at any time, by contacting us at: legal@cornucopialiving.com.

Sharing your personal information

We reserve the right to share your Personal Information with third parties to help us use your Personal Information, as described above.  For example, we may use third parties to make our Site and on-line store available, or to analyze your use of the Site, and we may also share your Personal Information as required by applicable law (such as responding to subpoenas or other lawful request for information we receive), or to otherwise protect our rights.

Business Transfer

It is possible that the Company might sell its business or buy businesses or their assets, or engage in transfers, acquisitions, mergers, restructurings, changes of control or similar transactions. In such transactions, Personal Information generally is one of the transferred business assets, and your Personal Information may be subject to such a transfer. Also, in the unlikely event of a bankruptcy, Personal Information may be transferred to a bankruptcy trustee or debtor in possession and then to a subsequent purchaser, however all the foregoing is subject to restrictions as set forth in any applicable laws.

California Privacy Rights

California Shine the Light Law: If you reside in California, you have the right to ask us one time each year if we have shared personal information with third parties for their direct marketing purposes. The California Consumer Privacy Act of 2018

The California Consumer Privacy Act of 2018 (“CCPA”) provides California consumers specific rights concerning their personal information, including, the right to request that we disclose what personal information we collect, use, disclose, and sell. This section describes your rights and how you may exercise those rights as well as describes how we and third parties handle your Personal Information.

We will not discriminate against you if you choose to exercise the above rights, however we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your Personal Information’s value and will be described to you in writing. Please note that participation in a financial incentive program requires your prior opt-in consent, which you may revoke at any time.

You have the right to request that we disclose certain information to you about our collection and use of your Personal Information over the prior 12 months. Once we receive and confirm your request, we will disclose to you:

The categories of Personal Information we collected about you;

The categories of sources for the Personal Information we collected about you;

Our business or commercial purpose for collecting or selling that Personal Information;

The categories of third parties with whom we share that Personal Information;

The particular Personal Information we collected about you;

If we sold or disclosed your Personal Information for a business purpose, two separate lists specifying disclosing (i) sales, identifying the Personal Information categories that each category of recipient purchased, and (ii) disclosures for a business purpose, identifying the Personal Information categories that each category of recipient obtained.

You also have the right to require, upon request, that (subject to certain exceptions) we delete any of your Personal Information that we collected from you and retained.  Once we receive and confirm your verifiable request to delete, we will delete (and direct our service providers to delete) your Personal Information from our records, unless an exception applies.  You may make such requests by calling 609-750-7172, or by sending an email to legal@cornucopialiving.com.   After submitting your request, please monitor your email for a verification email. We are required by law to verify your identity prior to granting access to or deleting your personal data in order to protect your privacy and security. To verify your identity, we require you provide your name and email or your email, an order number for your most recent purchase, your billing or shipping address for your most recent order, and/or the products purchased in your most recent order. For some requests, we may also require you to sign a declaration under penalty of perjury that you are the consumer whose personal information is the subject of the request.

Please note that you may designate an authorized agent to exercise these rights on your behalf by providing the authorized agent signed permission to submit the request on your behalf. If an authorized agent submits a request on your behalf, we may need to contact you to verify your identity and protect the security of your personal data.

Your request to know or request to delete may be denied for any reason allowable under the CCPA. For example, we may deny your deletion request:

(i) if retaining the information is necessary for us or our service provider(s) to complete the transaction for which we collected the Personal Information, provide a product that you requested, take actions reasonably anticipated based on our ongoing business relationship with you, or otherwise perform our obligations to  you;

(ii) to comply with a legal obligation; or

(iii) make other internal and lawful uses of that information that are compatible with the context in which you provided it or any other purpose permitted by the CCPA.

Similarly, we may deny requests:

(i) For specific pieces of Personal Information if the disclosure creates a substantial, clear and unreasonable risk to the security of that Personal Information, your account with us, or the security of our systems or networks;

(ii) If your identity cannot be verified to a degree of certainty required by the CCPA;  and

(iii) From an authorized agent that does not submit proof that they have been authorized by you to act on your behalf.

If you are 16 years of age or older, you have the right to opt-out from a sale of your Personal Information, and  we will not sell the Personal Information of persons we know are younger than 16 unless we receive affirmative authorization (the “right to opt-in”) from either a person who is between 13 and less than 16 years of age, or the parent or guardian of a consumer less than 13 years of age. Consumers who opt-in to Personal Information sales may opt-out of future sales at any time.

For purposes of exercising your rights above, please note the following regarding how we collect and use your Personal Information:

  • We may collect the following categories of Personal Information: identifiers; payment information; commercial information; internet of other electronic network activity information; geolocation data; audio, electronic or visual information.
  • We may disclose the following categories of Personal Information for a business purpose: identifiers; payment information; commercial information; device information; demographic information and driver’s license number.
  • We may sell the following categories of Personal Information: identifiers; payment information; event information; demographic information; device information; location information; commercial information; internet or other network activity information.

We may obtain the categories of Personal Information listed above from the following categories of sources: (i) directly from you or your agent, or indirectly from you or your agent (for example, through cookies and other automated technologies)l and (ii) directly and indirectly from activity on our Site.

We may use or disclose the personal information we collect for one or more of the following business purposes:

  • Administer and manage the Company;

Retention of Personal Information
